Welcome to Orbit Guides. This document establishes the rules and conditions for using the platform. By clicking "I Accept," logging in for the first time, or subscribing to a plan, you (hereinafter referred to as "Client") declare your full agreement with these Terms.

1. Purpose and License of Use

  • 1.1. The platform is a SaaS (Software as a Service) solution designed to centralize information about vacation rental properties.
  • 1.2. Orbit Guides grants the Client a temporary, revocable, limited, and non-exclusive license to use the platform for the duration of the contracted plan.
  • 1.3. Orbit Guides does not mediate reservations, payments, or contracts between the Client and their guests.

2. Plans, Terms, and Acceptance

  • 2.1. The Client subscribes to the chosen plan at the time of contracting, respecting the property and resource limits described in the current offer (Freemium, Starter, Essential, or Pro).
  • 2.2. Digital acceptance — through a mandatory checkbox during registration — replaces the physical signature and has full legal validity under Article 10 of Law No. 11.419/2006 and Article 107 of the Brazilian Civil Code.
  • 2.3. Orbit Guides may update these Terms at any time, with prior notice via email or within the platform with at least 15 days' notice. Continued use after the notice period constitutes agreement with the new conditions. If the Client does not agree, they may cancel their account without charge within that period.

3. Payment and Default

  • 3.1. Access is conditional upon timely payment of monthly fees according to the contracted plan.
  • 3.2. Delays exceeding 15 calendar days may result in suspension of platform access.
  • 3.3. After 60 days of default, data may be permanently deleted, with no right to recovery.

4. Cancellation, Refund, and Withdrawal

4.1 Right of Withdrawal (Art. 49 of CDC)

As this is a service contracted over the internet, individual Clients have the right to withdraw within 7 (seven) calendar days from the date of contracting, pursuant to Article 49 of the Brazilian Consumer Protection Code.

  • Cancellation requested within 7 days without using the platform: full refund of the amount paid, without any penalty. The refund will be processed within 7 business days, depending on the issuing bank, through Stripe.
  • Cancellation requested within 7 days with platform usage: since this is a digital service of immediate enjoyment, and provided the Client was informed of this condition at the time of registration, the refund may be denied or calculated proportionally to usage. Orbit Guides will evaluate each case in good faith.
  • Cancellation requested after 7 days: there is no refund of amounts already paid. Cancellation takes effect in the next billing cycle, meaning the Client will no longer be charged from the next period.

4.2 Regular Cancellation (after 7 days)

The Client may request cancellation at any time, without need for justification, by emailing info@orbitguides.com or through channels available on the platform.

  • Cancellation will be effective at the end of the already paid period, maintaining access until that date.
  • Data will remain available for up to 30 days after cancellation for possible export. After this period, it may be permanently deleted.

4.3 Plans with Commitment Period

Plans that include setup benefits (initial configuration, personalized onboarding, or differentiated discount) have a minimum term of 12 months. In case of early termination requested by the Client, a 30% penalty applies on the remaining contract balance. This condition is prominently disclosed at the time of contracting. Currently, the Pro Plan falls into this category. Other plans with equivalent benefits will be indicated as such at the time of contracting.

4.4 Access vs. Actual Use

The subscription guarantees the right to access the platform, regardless of actual use by the Client. Not using the available resources — including not creating guides or not publishing content — does not generate the right to refund, discount, or waiver of charges. The service is considered delivered from the moment access is provided.

5. Client Responsibilities

  • 5.1. The Client is solely responsible for the content they publish on the platform.
  • 5.2. The Client must guarantee they have all usage rights for images and materials published.
  • 5.3. Use of the platform for illegal, fraudulent purposes, or that violate third-party rights is prohibited.
  • 5.4. The Client is responsible for the confidentiality and proper use of their access credentials.

6. Intellectual Property

  • 6.1. The entire system, source code, architecture, brand, and visual identity belong exclusively to Júlia Bacchi (Orbit Guides).
  • 6.2. Reverse engineering, copying, modification, redistribution, or unauthorized use of the system is expressly prohibited, under penalty of a fine equivalent to up to 10 (ten) times the annual value of the contracted plan, without prejudice to losses, damages, and criminal liability.

7. Data Protection (LGPD)

  • 7.1. The Client acts as the Controller of guest data entered on the platform, being responsible for the legality of such processing under the LGPD.
  • 7.2. Orbit Guides acts as the Technical Operator, under the terms of Article 39 of Law No. 13.709/2018.
  • 7.3. Orbit Guides uses Google Analytics for collecting anonymous statistical data, subject to the user's express consent through the cookie banner.
  • 7.4. Data processing by Orbit Guides is governed by the Privacy Policy and Cookie Policy, both available at orbitguides.com, which form part of these Terms for all legal effects.

8. Limitation of Liability and Availability

  • 8.1. Orbit Guides does not guarantee specific financial results to the Client (obligation of means, not of result).
  • 8.2. The platform may undergo preventive or corrective maintenance, with prior notice whenever possible.
  • 8.3. Orbit Guides is not responsible for failures, policy changes, or unavailability of external platforms such as Google, Airbnb, Booking, or other third-party services.
  • 8.4. The maximum financial liability of Orbit Guides towards the Client, in any circumstance, is limited to the total amount paid in the last 12 months of the contract.

9. Price Adjustment

Orbit Guides may adjust plan values with at least 30 days' prior notice via email. If the Client does not agree with the new value, they may cancel their subscription without penalty before the adjustment effective date.

10. Jurisdiction and Applicable Law

These Terms are governed by Brazilian law. The jurisdiction of the District of Garopaba/SC is elected to resolve any disputes arising from this contract, with express waiver of any other, however privileged it may be.
